Changes to This Privacy Policy

We may update this Privacy Policy from time to time, to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on the Site, update the "Last updated" date at the top, and take any other steps required by applicable law.

What Personal Information We Collect

The information we collect depends on how you interact with us.

Information you give us directly

  • Contact details — your name, address, phone number and email.
  • Order information — your name, billing address, shipping address, payment confirmation, email address and phone number.
  • Account information — your username, password and other information used to keep your account secure.
  • Customer support information — whatever you choose to include when you write to us.

Some features require this information. You may choose not to provide it, but that may prevent you from using those features.

Information we collect about your usage

We may automatically collect information about how you interact with the Services ("Usage Data") using cookies, pixels and similar technologies. This may include device and browser information, your network connection, your IP address, the pages you view and the actions you take on the Site.

Non-essential technologies of this kind are only used after you consent — see Cookies and Similar Technologies below.

Information we obtain from third parties

We may receive information about you from service providers acting on our behalf, including:

  • Shopify, which hosts and powers our online store.
  • Our payment processors, who collect payment details (card or bank information, billing address) in order to process your payment and fulfil your order.
  • Printful, our print and fulfilment partner, which receives your name and shipping address in order to produce and ship your order.
  • Klaviyo, which we use for email marketing and onsite personalisation.
  • Analytics, attribution and advertising providers, which help us understand how our Site and advertising perform.

Any information we obtain from third parties is treated in accordance with this Privacy Policy.

How We Use Your Personal Information and Our Legal Bases

Providing products and services. We use your personal information to perform our contract with you (Article 6(1)(b) GDPR): to process payments, produce and fulfil your orders, arrange shipping, send you notifications about your order, handle returns and exchanges, and create and manage your account.

Marketing and advertising. We use your personal information to send you marketing communications and to show you advertising for our products.

If you are in the EEA or the United Kingdom, we rely on your consent (Article 6(1)(a) GDPR) for marketing emails and for advertising and analytics cookies. We ask for it through our cookie banner and our newsletter sign-up. Where you are already a customer, we may send you emails about similar products of our own on the basis of our legitimate interest (Article 6(1)(f) GDPR), in accordance with Article 13.º-A of Lei n.º 41/2004.

You can withdraw your consent at any time — use the unsubscribe link in any email, or reopen the cookie banner through the "Cookie preferences" link in our footer. Withdrawing consent does not affect processing carried out before you withdrew it.

Security and fraud prevention. We use your personal information to detect, investigate and act on possible fraudulent, illegal or malicious activity. This is in our legitimate interest in keeping the Site secure for you and other customers (Article 6(1)(f) GDPR). If you register an account, you are responsible for keeping your credentials safe. If you believe your account has been compromised, contact us immediately.

Communicating with you and improving our Services. We use your personal information to provide customer support and to improve the Services. This is in our legitimate interest in being responsive to you and maintaining our business relationship with you (Article 6(1)(f) GDPR).

Legal compliance. We use your personal information to comply with our legal obligations, including tax and accounting obligations (Article 6(1)(c) GDPR).

Cookies and Similar Technologies

On your first visit we ask for your consent through our cookie banner. Only strictly necessary technologies — those that keep your cart, your language, your currency and your session working — are used before you make a choice. Everything else, including analytics, attribution and advertising, waits for your consent.

You can change or withdraw your choice at any time through the "Cookie preferences" link in our footer.

For details of the cookies used to power our store through Shopify, see https://www.shopify.com/legal/cookies.

Browser settings are not how we ask for your consent, but you can additionally set your browser to remove or reject cookies. Blocking cookies may cause parts of the Site to stop working correctly.

We recommend that you do not use insecure channels to send us confidential information.

Depending on where you live, you have some or all of the rights below. These rights are not absolute, apply only in certain circumstances, and in some cases we may decline a request where the law permits.

We will not discriminate against you for exercising your rights. We may need to verify your identity before we act on a request. You may appoint an authorised agent to make a request on your behalf, in which case we will require proof of that authorisation.

Complaints

If you have a complaint about how we handle your personal information, please contact us first at support@homeofsaudade.com — we would rather resolve it with you directly.

If you are not satisfied with our response, you have the right to lodge a complaint with the Portuguese supervisory authority:

CNPD — Comissão Nacional de Proteção de Dados www.cnpd.pt

If you live in another EEA country, you may lodge your complaint with your local data protection authority instead.

Our Site may link to websites operated by third parties. If you follow those links, review their privacy and security policies — we do not control them and are not responsible for their content or practices. Information you share on public or semi-public platforms, including social networks, may be visible to others. A link on our Site does not, by itself, imply that we endorse that site.

Children's Data

The Services are not intended for children, and we do not knowingly collect personal information about children. Under Portuguese law (Lei n.º 58/2019), children under 13 cannot consent to the processing of their data in relation to information society services. As of the date at the top of this Privacy Policy, we have no actual knowledge that we share or sell the personal information of individuals under 16 years of age.
